Formlabs Inc. and its subsidiaries (collectively, “Formlabs” or “we”) are committed to protecting your privacy. This privacy policy (“Privacy Policy”) applies to the data that we collect through our websites, including formlabs.com, as well as our products and services (collectively, “Services”). This Privacy Policy governs our data collection, processing, and usage practices.

We may update this Privacy Policy from time to time at our sole discretion by posting a new version online. You should check this page occasionally to review any changes, signified through an “Updated” date at the top of this page. We will provide notice of any material changes by doing one or more of the following: a) posting the changes on or through the Services, b) sending you an email or message about the changes, or c) posting an update on our websites and changing the "Updated" date above. Your continued use of the Services and continued provision of information to us will be subject to the revised terms of the then-current Privacy Policy.

Collection and Use of Information

When you use our Services, we may collect certain Personal Information, Navigational Information, or Analytical Information (each as defined below). You can often choose what information you provide, but from time to time we may require certain information in order to provide the Services to you. The use of any information we collect is governed by the relevant current legislation in your region as well as this Privacy Policy.

Personal Information

“Personal Information” is any information that identifies or could be reasonably used to identify an individual person. The types of Personal Information we may collect include:

  1. Contact and Account Information: We receive contact and account information about you and your organization when you purchase or use our Services. This may include your name, telephone number, address, email address, country, company name, and job title. Contact and account information may be used to provide our Services to you, process your transactions, fulfill your requests, manage customer accounts, provide customer service, verify customer information, process payments, and advertise our Services.

  2. Payment Information: We receive payment information when you purchase our Services. This may include your Contact and Account Information, bank details, payment method, card type, expiration date, certain digits of your card number, and details of your payment history. Payment information is used to check your financial qualifications and collect payment from you for Services through a third-party payment processor.

  3. Communications with Formlabs: We receive information when you communicate with Formlabs, including when you complete forms through our Services, communicate with us through social media, sign up for marketing communications, or submit an inquiry. This may include your Contact and Account Information, feedback on our Services, and customer testimonials. Your communications may be used to provide our Services to you, process your transactions and requests, provide customer service, advertise our Services, and evaluate and improve our Services.

  4. Employment Applications: We receive information when you apply for job opportunities at Formlabs. This may include your name, telephone number, address, email address, resume, cover letter, work history, and other employment-related information. Employment applications may be used to consider your qualifications for the role for which you have applied, to consider your qualifications for other roles for which you may be qualified, and to communicate with you about the recruitment and employment process.

  5. Printer Camera Information: Certain Formlabs 3D printers include a camera that can capture videos and photos of your prints throughout the print process. These videos and photos may also capture images of the space surrounding the 3D printer, including images of any individuals near the 3D printer at the time the video or photo is being taken. We only collect printer camera information with your consent, which may be provided during printer set-up. Once you consent to share printer camera information with us, we will continue to collect printer camera information for all prints until you opt-out. If you use the camera either for internal purposes or to share printer camera information with Formlabs, you are responsible for obtaining any necessary consents from and providing notice to the individuals whose images may be captured by the camera. If you consent to share printer camera information with us, we may use that information to provide customer service and to evaluate and improve our Services.

  6. Log Files: We receive information through log files created when you use our Services. This may include your user name, WI-FI network name, and IP address. Log files may be used to provide our Services to you, maintain the security of our Services, and to evaluate and improve our Services. 

In addition to the uses outlined above, we may also use your Personal Information as necessary to comply with applicable laws, regulations, and legal process and to carry out our other legitimate business purposes. 

We use a variety of security technologies and procedures to help protect your Personal Information from unauthorized access, use, and disclosure, and we never sell your Personal Information to third parties. 

We retain the Personal Information you provide us for only as long as a) you provide consent; b) we have a legitimate interest in retaining such Personal Information; or c) retention is required under applicable law, regulation, or legal process. You may revoke your consent at any time and object to future uses of your Personal Information by following the process outlined under “Unsubscribing” below. Following the revocation of your consent, Formlabs may continue to retain and use your Personal Information to the extent necessary to comply with our legal obligations, resolve disputes, enforce agreements, and as otherwise necessary to carry out our other legitimate interests as described in this Privacy Policy.

Navigational Information

“Navigational Information” means information about your computer and other devices that you use to access the Services, including your IP address, domain name, device name and model, operating system, unique identifier, access provider, geographical location, browser type, referral source, access times, length of visit, and pages viewed.

We receive Navigational Information when you access and use the Services. Navigational Information may be used to provide the Services to you, advertise our Services, track and analyze how our users interact with our Services, evaluate and improve our Services, comply with applicable laws, regulations, and legal process, and carry out our other legitimate business purposes.

Our websites may include social media features, such as the Facebook “Like” button, and widgets, such as the “Share This” button. These features may also collect certain Navigational Information and may set cookies to enable the feature to function properly. Such social media features and widgets are either hosted by a third party or hosted directly on our websites. Your interactions with these features and widgets are governed by the privacy policies of the companies providing them.

Analytics and Print Information

"Analytics Information" means information about your use of the Services, including hardware serial numbers, operating system information, CPU and memory usage, firmware version, calibration data, printer configuration files, Wi-Fi network name and settings, print jobs, printer logs, odometry metrics, print times, laser power levels, resin type, resin volume, temperature, 3D model sizes, print photos, hardware performance metrics, on-printer licenses, and print file names and file paths. During installation, you may be asked to consent to the collection of Analytics Information in order to help us evaluate and improve our Services. If you consent, you agree that Formlabs may collect, maintain, and use such Analytics Information.

"Print Information" means information about your prints, including 3D geometry, support and raft data, resin type, layer height, metadata, unique job identifier, PreForm version, and printer serial number. By using our Remote Printing & Monitoring feature, you consent to share Print Information with Formlabs in order to remotely upload your print to the designated printer through our Dashboard or Fleet Control platforms. You may also be asked to consent to the collection of Print Information in order to help us evaluate and improve our Services. If you consent, you agree that Print Information may be used by Formlabs solely for internal purposes in accordance with this Privacy Policy. You agree not to share Print Information with Formlabs if it could contain (i) "protected health information" under the Health Insurance Portability and Accountability Act ("HIPAA") or (ii) export-controlled information under the International Traffic in Arms Regulations ("ITAR"), Export Administration Regulations ("EAR") or other applicable export control laws, other than information classified as EAR99. You agree to indemnify Formlabs from any liability resulting from your disclosure of protected health information or export-controlled information to Formlabs in violation of this paragraph.

If you choose to create an online account with Dashboard or Fleet Control, or use a printer that has been previously connected to Dashboard or Fleet Control, you agree that Formlabs may collect, maintain, and use Analytics Information, an isometric view of your 3D models for preview purposes, and other data relevant to printer operation. Full models and 3D geometry will not be collected without your additional and explicit consent. Information collected by Dashboard and Fleet Control will be associated with specific printers, identifiable by serial name. Users will access the printer through an encrypted MAC address where they will be prompted to create a username and password. Users who create an account will be able to associate printers with their account using the unique encrypted MAC address of the printer accessible via the printer’s user interface. Multiple user accounts may be associated with each printer, but each user must have physical access to the printer. Each user will be able to see every print job queued to the printer, but will be unable to associate print jobs with specific users unless the users self-identify in the print job’s title.

In addition to the uses identified elsewhere in this Privacy Policy, we may use Analytic Information and Print Information for other purposes, including to evaluate and improve our Services; to make adjustments to the print process; to identify common failure modes; to monitor print experience satisfaction; to populate Dashboard and Fleet Control with a queue of print jobs previously executed or to be executed; to provide printer operation status; to track consumable inventory; to display model previews within the user interface; to comply with applicable laws, regulations, and legal process; and to carry out our other legitimate interests.

Information About Children

The Services are not intended for or targeted to children under thirteen years old, and we do not knowingly or intentionally collect information about children under the age of thirteen. If you believe that we have collected information about a child under the age of thirteen, please contact us at [email protected], so that we may delete such information.

External Websites

Services may provide links to other websites. We do not control, and are not responsible for, the content or practices of these other websites. Our provision of such links does not constitute our endorsement of these other websites or their content, owners, or practices. This Privacy Policy does not apply to these other websites, which are subject to any privacy and other policies they may have.

Public Forums

We may offer publicly accessible message boards, blogs, and community forums. Please keep in mind that if you directly disclose any information through our public message boards, blogs, or forums, this information may be collected and used by others. We are not responsible for the use or disclosure of any information shared on public forums.

Export Compliance

You agree not to provide any information, data, technology, models, documents, or other materials to Formlabs that are restricted by any United States or international export control law, including ITAR, EAR, and other applicable export control laws, other than materials classified as EAR99. 

Disclosure of Collected Information

We may disclose your information to Formlabs’ subsidiaries, affiliates, service providers, resellers, and distributors.

  1. Service Providers: We may engage third parties to act as our service providers and perform certain tasks on our behalf, such as analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These service providers only have limited access to your information, may only use such information to perform tasks on our behalf, and are obligated to us not to disclose or use your information for other purposes.

  2. Resellers and Distributors: We partner with certain third parties to resell and distribute our Services and to provide customer service. We require all resellers and distributors to protect your information.

  3. Business Transfers: In the event that Formlabs is acquired by another company (whether by merger, acquisitions, bankruptcy, or otherwise), the acquiring company will receive all of the information, including Personal Information, collected by Formlabs. You acknowledge that such acquisitions may occur and that the acquiring company may continue to use your information as set forth in this Privacy Policy.

We reserve the right to use or disclose your Personal Information other than as described above if required by law, regulation, or legal process or if we reasonably believe that such disclosure is necessary to protect our rights.

We will not share your mobile information for marketing/promotional activities with any third parties. We will not share your text messaging opt-in data and consent will not be shared with any third parties.

Cookies and Data Trackers

When you use our Services, we obtain certain information by automated means, such as cookies, web beacons (including pixels and tags), web server logs, and other similar technologies which store information on your device or access information already stored in your device (collectively “Cookies”). Our Cookies Policy explains how we use Cookies, their purposes, and how you can control them.

Unsubscribe

You may unsubscribe from our marketing communications by clicking on the “unsubscribe” link located at the bottom of our emails or by contacting us via email at [email protected] or via mail to Formlabs Inc., Attention: Privacy, 35 Medford Street, Somerville, MA 02143, United States. Customers cannot opt-out of receiving transactional emails related to their account with us or our store as these communications are necessary for the completion of the Services.

European, United Kingdom, and Swiss Requirements

This section applies to users located in the European Union, United Kingdom, and Switzerland and supplements the Privacy Policy.

Legal Basis for Processing

We process your Personal Information in accordance with applicable European data protection regulations, including the General Data Protection Regulation (“GDPR”). For the purposes of the GDPR, you will be the data controller and Formlabs will be the data processor with respect to any Personal Information described in this Privacy Policy.

Depending on the specific Personal Information concerned and the factual context, we will process your Personal Information under one or more of the following legal bases:

  1. Performance of a Contract: It is necessary for Formlabs to process your Personal Information to comply with obligations under a contract with you, including Formlabs’ obligations under the Formlabs Terms of Service.

  2. Consent: You have given us your explicit consent to process your Personal Information.

  3. Legitimate Interest: Formlabs has a legitimate interest in processing your Personal information.

  4. Legal Obligations: Formlabs is required to process your Personal Information to comply with our obligations under law or regulation.

Data Subject Rights

If you provide us with your Personal Information, you have the following rights with respect to that information. Where applicable, these rights are intended to align with Chapter 3 of the GDPR:

  • Have transparent, plain-language communication regarding your Personal Information

  • Revoke your informed consent at any time

  • Review the Personal Information that you have supplied to us and how this Personal Information has been used, including any international transfer history

  • Request that we correct any errors, outdated information, or omissions in the Personal Information that you have supplied to us

  • Request that your Personal Information not be used to contact you

  • Request that your Personal Information be removed from any solicitation list that we use

  • Request that your Personal Information be deleted from our records; and

  • Opt-out of being solicited by us or third parties

Without prejudice to any other administrative or judicial remedy, you have the right to complain to a supervisory authority – in particular, such supervisory authority in the member state of your place of residence or employment or in the place of the alleged infringement – if you believe that our processing of your personal data violates the GDPR.

International Transfer of Information

Formlabs operates globally, and we may need to transfer and access your Personal Information from around the world, including the United States. You consent to the transfer to, processing of, and storage of your Personal Information in the United States and other countries outside of the European Economic Area (the “EEA”), the United Kingdom, and Switzerland, the privacy laws of which may be considered less strict than those of your region. This consent applies in addition to our other legal grounds for transfering, processing, and storing your Personal Information as outlined in this Privacy Policy.

Any transfer of Personal Information outside of the EEA, the United Kingdom, or Switzerland is governed by the Standard Contractual Clauses.

U.S. State Law Requirements

This section applies to users located in California, Colorado, Connecticut, Utah and Virginia and supplements this Privacy Policy. This section provides disclosures required under the California Consumer Privacy Act (“CCPA”), Colorado Privacy Act (“CPA”), Connecticut Act Concerning Personal Data Privacy and Online Monitoring (“CTDPA”), the Utah Consumer Privacy Act (“UCPA”) and the Virginia Consumer Data Protection Act (“VCDPA”, and along with CCPA, CPA, CTDPA, and UCPA, collectively the “U.S. Privacy Acts”).

Data Rights

If you are located in a state governed by a U.S. Privacy Act, then you have the following rights with respect to your Personal Information.

  1. Right to Know: Twice per year, you may request that Formlabs disclose the Personal Information we have collected, used, disclosed, and sold in the past twelve (12) months. 

  2. Right to Delete: You may request the deletion of the Personal Information that we have collected from you. Please note that we may deny your request for deletion where an exception exists. 

  3. Right to Correct: You may request that we correct inaccurate Personal Information.

  4. Right to Non-Discrimination: You have the right not to be discriminated against for exercising any of these rights.
